Terms of Service

1. Acceptance of Terms

By creating an account or using Miles Further ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Miles Further is a running coaching platform operated by MSD OutCast, LLC. The Service pairs a deterministic training plan engine, built on the published work of Jack Daniels, Pete Pfitzinger, Stephen Seiler, Joe Friel, and other world-renowned coaches and researchers, with AI augmentation that layers personalized coaching notes, conversational guidance, and adaptive recommendations on top using Anthropic's Claude. Heart rate zone training is the primary intensity framework. The Service serves beginners building their first running base, competitive athletes pursuing race goals, and masters runners who need age-appropriate training protocols, supported by a library of nearly 400 evidence-based coaching principles with explicit source attribution.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

4. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent that you meet this requirement.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Create multiple accounts to circumvent usage limits or trial restrictions
• Resell, redistribute, or commercially exploit the Service or its content
• Use automated tools to scrape or extract data from the Service
• Share your account credentials with others

6. Third-Party Integrations

The Service integrates with third-party platforms including Strava. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or functionality of third-party services.

We integrate with Strava under Strava's API Agreement and Brand Guidelines, and we honor user revocations immediately. When you revoke access through Strava or choose to delete your Strava-sourced data through your Miles Further account, the data is purged from our database as described in our Privacy Policy.

7. AI-Generated Content

The AI-generated content provided by Miles Further (including personalized coaching notes, chat responses, explanations, and recommendations) is produced using Anthropic's Claude. This AI-generated content:

• Is provided for informational and educational purposes only
• Does not constitute professional medical, coaching, or health advice
• May contain errors or inaccuracies inherent in AI technology
• Should be used in conjunction with, not as a replacement for, professional guidance

Training plan structures (workout sequences, phase allocation, recovery cycles) are generated by a deterministic algorithm, not by AI, and are based on established training science. The AI-personalization layer adds individualized coaching notes and conversational guidance on top of the deterministic plan.

8. Subscription and Payments

The Service offers a single-tier subscription available on monthly and yearly billing periods. Pricing, features, and any trial terms are as displayed at the time of purchase. We reserve the right to change pricing with 30 days notice to existing subscribers. During beta testing, access may be provided free of charge at our discretion.

9. Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You retain access through the end of your current billing period
• Your data is preserved for 90 days in case you return
• After 90 days, you may request complete data deletion

10. Intellectual Property

The Service, including its design, code, AI models, coaching algorithms, and content, is the property of MSD OutCast, LLC. Your training data remains your property. AI-generated coaching content provided to you may be used for your personal training purposes.

11. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data.

12. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

13. Limitation of Liability

To the maximum extent permitted by law, MSD OutCast, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless MSD OutCast, LLC from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third party's rights.

15. Modifications to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or in-app notification.

16. Termination

We reserve the right to suspend or terminate your account for violation of these terms, abusive behavior, or at our discretion with reasonable notice. You may terminate your account at any time by contacting us.

17. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws provisions. Any disputes shall be resolved through binding arbitration or in the state and federal courts located in the Commonwealth of Pennsylvania.
